Dependents

  • Spouses and unmarried children under the age of 21 of H-1B status holders are considered dependents and are eligible for H-4 status.
  • H-4 status holders are only eligible to stay in the U.S. while their H-1B spouses or parents are in the U.S. maintaining the terms and conditions of their H-1B visa status. 
    • H-4 visa holders are not permitted to work in the U.S. and are not eligible to obtain Social Security Numbers.
    • H-4 visa holders may apply to change their visa status to H-1B if they qualify for a specialty occupation position and find an employer who is willing to file a petition on their behalf.
    • H-4 visa holders may study in the U.S., full-time or part-time, for the duration of the H-1B's period of stay.
  • If needed, the University’s immigration legal counsel will process the necessary paperwork for H-4 dependent status. Please contact the Human Resources (HR) Department regarding the fees. 

Family Members Residing Outside the U.S.

  • Family members residing outside the U.S. when an H-1B petition is submitted and approved do not need to submit any documents to US Citizenship and Immigration Services (USCIS) to obtain H-4 status.  Instead family members should apply for an H-4 visa stamp at the U.S. consulate overseas. 
  • Family members should consult the U.S. Department of State before they visit their consulate to determine which documents their consulate requires to issue an H-4 visa.

Family Members Residing Within the U.S.

  • Family members residing within the U.S., the foreign national needs to notify the hiring department and the Human Resources (HR) Department before the H-1B petition if filed so that both the H-1B Petition and H-4 Application are filed at the same time.

H-4 Fees

Foreign national employees are responsible for paying the US Citizenship and Immigration Services (USCIS) filing fees associated with their dependents and may pay this fee by personal check, certified check or money order made payable to the Department of Homeland Security.
