Fee Requirements

The employing department is responsible for all fees associated with the H-1B Petition and will need to provide the Human Resources (HR) Department with a budget code.

H-1B Petition Filing Fee
$325 - This fee is for the filing of the petition and is made payable to the Department of Homeland Security.

Fraud Prevention and Detection Fee
$500 - This is a one-time fee that is made payable to the Department of Homeland Security.

  • This fee is required for any employee seeking H-1B status with Clarkson even if they are already in the U.S. in H-1B status with another employer.
  • The Fraud Prevention and Detection Fee are not required for a petition extending H-1B status with the same employer.
University’s Immigration Legal Counsel Fee
  • A retained law firm processes the H-1B petition and the legal fees associated with the petition are based on the visa category. 
  • Please contact the HR Department for details.

(Optional) Premium Processing Fee
$1,225 - Depending on the timing of the petition, it may be necessary to fast-track the petition with the Premium Processing option. 

  • It is strongly urged that the hiring department pursue a Premium Processing upgrade of an H-1B petition if it has been filed regular processing and the new foreign national employee has not received his/her approval notice at three weeks prior to the requested employment start date.
  • The Premium Processing fee may be paid by the department or the employee.
    • The foreign national may choose to pay the Premium Processing fee if expedited processing is requested for personal reasons unrelated to employment. 
    • Premium Processing is not normally necessary with H-1B extensions.
