J-2 Work Authorization

J-2 dependents can apply for employment authorization from USCIS – this authorization is known as an Employment Authorization Document (EAD). J-2 dependents are eligible to apply for employment authorization as long as the employment is not for the purpose of supporting the J-1 principal exchange visitor. J-2 dependents do not need to demonstrate financial need to receive employment authorization – only indicate the reason employment is desired.

               NOTE – you may not being employment until your EAD card has been approved and received.

How to Apply

Prepare and compile the following documents – (suggested order)

    • Completed I-765 form
      • Check the box ‘Permission to accept employment’ and complete lines 1-16
      • #3 Return Address – please be sure this is an address that will be valid for at least 6-months – if not, you may wish to use the address of ISSS and we will notify when the information has been received.
      • ISSS Address: c/o ISSS, PO Box 5651, Potsdam, NY 13699-5651
    • Certification – sign and date I-765
    • Check or moneyorder made payable to USCIS for $380
    • Two U.S. passport style photos
    • Copies of –
      • Current DS-2019 of the J-2 dependent and J-1 principal
      • J-1 & J-2 passport/visa
      • Electronic print-out of I-94 admission number or front/back of I-94 card of both the J-1 & J-2 dependent
    • Letter from J-2 dependent stating why the employment is desired, indicating the source & amount of support of the principal J-1 exchange visitor and stating specifically that the income from the employment will not be used to support the J-1 exchange visitor.

Mail the above documents to USCIS for review – see USCIS specific filing locations according to your return address – however – if you are applying from New York you will mail to the USCIS lockbox location in Dallas.
